RECOMMENDATIONS ON THE DEVELOPMENT OF LICENSED SUBSOIL AREAS ASSOCIATED (COMBINED) WITH SPECIALLY PROTECTED NATURAL AREAS

Annotation:

The legal regime of specially protected natural areas prohibits any other types of economic activities that impede the preservation, restoration and reproduction of natural complexes and their components. The owners of licensed areas face serious problems that significantly complicate the implementation of license agreements that restrain the growth of hydrocarbon reserves, up to the refusal of oil and gas companies from investment and economic activities ("zero option") in disputed or conflict areas in the presence of a valid license issued in accordance with the RF law "On the Subsoil". A specific example shows the solution of a conflict situation caused by a legal collision – the combination of a licensed subsoil area with specially protected areas. The procedures of issuing licenses for the use of subsurface resources and the creation and expansion of protected areas have been analyzed. Recommendations are given for the development of licensed subsoil areas associated (combined) with specially protected natural areas.
